These Terms of Service (“Terms”) govern purchases, website use, customer accounts, custom orders, replacement part orders, support, warranty claims, and related transactions with Cosmic Trailers LLC, DBA Bad Lemon Gaming. By using our website, creating an account, submitting an order, paying a deposit, approving artwork, or purchasing products, the customer agrees to these Terms.
Bad Lemon Gaming manufactures and sells commercial arcade game systems, freestanding stage-truss-style game systems, entertainment systems, machinery, and replacement parts. We do not provide event rentals, rental operation services, permitting services, event staffing, venue approvals, inspections, transportation systems, or customer event management.
Customers must be at least 18 years old and legally able to enter binding contracts. Products are intended for commercial use by qualified purchasers and operators, including event rental companies, businesses, organizations, schools, churches, and similar customers.
Products are made to order unless expressly stated otherwise. We may refuse, reject, or cancel an order for any lawful reason, including unavailable materials, safety concerns, suspected fraud, payment issues, operational constraints, customer artwork concerns, or inability to fulfill the requested order.
Lead times are estimates only and are not guaranteed. Delayed artwork, delayed approvals, delayed custom services, delayed payment, delayed shipping coordination, customer changes, supply chain delays, weather, carrier delays, labor constraints, or other circumstances may extend the lead time.
Customers are responsible for providing accurate shipping information and coordinating delivery availability. We may share necessary shipment information with third-party logistics providers. Customers must inspect freight before signing delivery paperwork and must note visible damage with the carrier when applicable.
Shipping damage must be reported to Bad Lemon Gaming within 48 hours of delivery. When timely reported, we will work with the shipping company to pursue a claim and, when appropriate, ship replacement parts or components. Failure to inspect freight or report damage within 48 hours may limit available remedies.
Unless separately agreed in writing, Bad Lemon Gaming does not install products. The customer is responsible for setup, anchoring, supervision, staffing, maintenance, storage, permits, inspections, venue approvals, local code compliance, insurance, safe operation, and compliance with all manuals, warnings, labels, checklists, and instructions. Bad Lemon Gaming does not participate in customer rental activities or event operations.
Customer-submitted artwork, logos, graphics, names, trademarks, and design files remain owned by the customer or the applicable rights holder. Bad Lemon Gaming will not resell customer-owned custom artwork. By submitting content, the customer grants Bad Lemon Gaming the right to use the content to design, manufacture, sell, ship, document, service, and support the customer order.
The customer is solely responsible for obtaining all rights, licenses, consents, and permissions for submitted content. The customer agrees not to submit content that infringes any trademark, copyright, right of publicity, privacy right, or other legal right. Bad Lemon Gaming may reject illegal, infringing, offensive, or inappropriate content.
Bad Lemon Gaming owns the designs, drawings, CAD files, manufacturing files, software, electronics layouts, documentation, trade dress, processes, brand materials, and other intellectual property it creates, except for customer-owned materials supplied by the customer. Customers may not copy, reverse engineer, clone, reproduce, resell, or create knockoff versions of Bad Lemon Gaming products, designs, replacement parts, files, controller systems, software, electronics, or related materials.
Customers may create accounts for order history, tracking, ordering, and warranty claims. Customers are responsible for maintaining account security and for all activity under their accounts. We may suspend or terminate accounts for misuse, suspected fraud, nonpayment, violation of these Terms, or security reasons.
Customers must follow all manuals, warnings, safety labels, setup instructions, inspection checklists, maintenance requirements, and operating limitations. Products must be anchored, inspected, and supervised as required. Unauthorized modifications, welding, structural changes, added electronics, controller tampering, or connection of unauthorized devices are prohibited.
The Limited Warranty Policy and Refund & Cancellation Policy are incorporated into these Terms. To the extent there is a conflict, the more specific policy controls for the relevant issue.
To the maximum extent permitted by law, Bad Lemon Gaming is not liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for claims arising from customer event operation, rental activities, venue conditions, inadequate supervision, improper setup, unauthorized modification, misuse, weather, third-party conduct, or failure to follow instructions. Our total liability for any claim will not exceed the amount paid by the customer for the specific product giving rise to the claim, except where prohibited by law.
The customer agrees to defend, indemnify, and hold harmless Cosmic Trailers LLC, DBA Bad Lemon Gaming, its owners, employees, contractors, suppliers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from customer content, customer event operations, rental activities, misuse, improper setup, failure to supervise, failure to follow instructions, violations of law, or breach of these Terms.
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute will be handled in Ohio through the dispute process selected by Bad Lemon Gaming, including negotiation, mediation, arbitration, or court proceedings in a proper Ohio venue, to the extent permitted by law.
We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date. Continued use of the website or purchase of products after changes are posted means the revised Terms apply.
