This Safety, Assumption of Risk & Liability Waiver applies to purchasers and operators of Bad Lemon Gaming arcade game systems, entertainment systems, machinery, and related equipment. By purchasing, accepting delivery, setting up, operating, renting, lending, reselling, or allowing use of the equipment, the buyer agrees to this waiver and safety agreement.
Bad Lemon Gaming sells equipment only. Bad Lemon Gaming does not operate customer events, provide rental services, supervise players, staff venues, obtain permits, inspect venues, manage crowds, or control the conditions where the equipment is used. The purchaser is solely responsible for setup, anchoring, inspection, supervision, safe operation, weather monitoring, insurance decisions, venue compliance, permits, local requirements, and event operations.
The purchaser understands that arcade and entertainment equipment may involve risks, including trips, falls, basketball impacts, collisions, crowd misuse, climbing, hanging, pinch points, electrical hazards, tip-over risks, weather-related hazards, improper setup, improper anchoring, equipment misuse, use by children, venue hazards, and risks created by customer rental operations or event activities. The purchaser knowingly assumes these risks on behalf of its own operation and use of the equipment.
Equipment must always be anchored to the ground or stabilized with approved stakes, weights, ballast, or other secure methods appropriate for the location and surface. The purchaser must inspect anchoring before use and during operation. If the equipment shifts, sways, lifts, becomes unstable, or cannot be properly anchored, use must stop immediately.
Equipment may be used indoors or outdoors only when conditions are safe and the equipment is properly anchored, monitored, and operated. The equipment is water-resistant, not waterproof. It must not be used in snow, hail, lightning, heavy rain, flooding, heavy wind, storms, or unsafe weather. Outdoor operation requires active monitoring of weather and equipment condition.
Conservative wind recommendation: Do not operate outdoors if sustained winds or forecasted gusts exceed 20 mph. If wind increases, weather becomes unsafe, anchoring shifts, or the unit begins moving, swaying, lifting, or becoming unstable, stop use immediately and secure or dismantle the equipment.
Unauthorized modifications are prohibited, including welding, cutting, drilling, modifying structural parts, modifying clamps or stage trusses, adding electronics, altering wiring, changing sensors, modifying controllers, connecting unauthorized devices, bypassing safety systems, or using non-approved replacement parts. Unauthorized modifications may void the warranty and create unsafe conditions.
Before each use, the purchaser/operator should inspect at minimum:
The purchaser should maintain visible warning labels and replace them when damaged, missing, or unreadable. Recommended labels include: adult supervision required; no climbing/hanging/dunking; anchor before use; water-resistant not waterproof; electrical warning; pinch point warning; inspect before use; authorized service only; safe play instructions; commercial equipment/not a toy.
Bad Lemon Gaming does not decide what insurance the purchaser must carry. The purchaser should consult its insurance provider regarding liability, property, commercial general liability, rental operation, event operation, and inland marine or equipment coverage appropriate for its business.
To the maximum extent permitted by law, the purchaser releases Cosmic Trailers LLC, DBA Bad Lemon Gaming, and its owners, employees, contractors, suppliers, and affiliates from claims, injuries, damages, losses, costs, and liabilities arising from customer setup, rental operation, event operation, supervision, venue conditions, weather, misuse, unauthorized modification, failure to inspect, failure to anchor, failure to follow instructions, or third-party conduct.
The purchaser agrees to defend, indemnify, and hold harmless Cosmic Trailers LLC, DBA Bad Lemon Gaming, and its owners, employees, contractors, suppliers, and affiliates from claims, injuries, damages, losses, liabilities, costs, and expenses arising from purchaser operation, rental activities, event use, venue conditions, player conduct, child use, customer negligence, unsafe setup, weather operation, unauthorized modifications, failure to supervise, or failure to follow manuals, warnings, labels, and instructions.
The purchaser acknowledges that it has read and agrees to this Safety, Assumption of Risk & Liability Waiver, understands the risks of arcade and entertainment equipment operation, and accepts responsibility for safe setup, supervision, operation, maintenance, inspection, and compliance.
By purchasing, accepting delivery, setting up, operating, renting, lending, reselling, or allowing use of Bad Lemon Gaming equipment, the purchaser accepts this waiver on behalf of its business and its operations. A signed copy may be requested as part of your order.
